Operating Without a Hospital License 

A hospital license is required for any veterinary or animal clinic that offers overnight care to patients. Any business that is not a licensed hospital cannot offer these services, even if they have veterinarians on staff. 

A license shall not be revoked, suspended, limited or annulled without a hearing. The commissioner may, however, impose an order to restrict or prohibit the placement of new patients, remove some or all of the existing patients, or suspend or limit the payment of governmental funds to the hospital. 

A hospital, short-term general hospital, outpatient surgical facility and outpatient clinic licensed by the commissioner must include in the records of all trauma patients an international code known as an E-code. An employee of any such entity who, in good faith and without gross negligence or wilful or wanton misconduct, reports an injury to the police department, cooperates during an investigation or proceeding concerning the reported wound, or preserves or surrenders an item relating to a reported wound, shall be immune from civil or criminal liability.

No person shall operate or use the term “hospital” in any way, including using it as a business name, without having obtained a hospital license. This applies even to veterinary hospitals.

Veterinary hospitals must be licensed for the practice they conduct. Unlicensed facilities can be subject to disciplinary action and fines and must stop operating until they obtain a license.

The proceedings and data, documents, records, and information referred to in subsection (A)(1) are confidential and may not be disclosed or used in any civil action except when the affected person and the hospital agree in writing to waive confidentiality in such an action. This section does not prevent an affected person from bringing a civil action against the hospital, its parent corporations, subsidiaries, or directors, officers, or employees. The court in that action shall determine whether or not a waiver has been made.
